TUESDAY, APRIL 10, 2007

The regular meeting of the Handy Township Board of Trustees was called to order in the Handy Township Boardroom by Supervisor Denby at 7:30 P.M.  Members present: Eisele, Tesch, Vaupel and Redinger.  Absent: none.  Also present: Township Attorney – Kehoe, Zoning Administrator – Anderson, Ken Cousino – Engineering Technologies, Kevin Shopshire, Kevin Swisher, and residents: Patty King and Ron Hogbin.

Approval of Agenda
MOTION REDINGER SUPPORT VAUPEL TO APPROVE THE AGENDA AS PRESENTED.  MOTION CARRIED.

OF THE SPECIAL BOARD MEETING OF 3-23-2007 AS AMENDED. 
MOTION CARRIED.

Approval of Bills
Supervisor Denby received a bill for appraisal in the amount of $2,500 that needs to be added to the bills for 4-10-2007.
MOTION EISELE SUPPORT TESCH TO PAY THE BILLS OF 4-10-2007 IN THE AMOUNT OF $98,895.60 FROM THE APPROPRIATE ACCOUNTS.  MOTION CARRIED.

A transfer in the amount of $10,000.00 is recommended by Clerk Eisele to cover the current and possible additional expenses for repairs and maintenance for the Twp. Hall.
MOTION EISELE SUPPORT VAUPEL TO TRANSFER $10,000.00 FROM THE CONTINGENCY FUND ACCT. #101-890-999 TO BUILDING REPAIRS AND MAINTAINANCE ACCT.  #101-265-931.  MOTION CARRIED.

Pending Business

  1. Engineer’s Report

Update on West Grand River, believe that they have a way to get under Nicholson Road, will be going out for bids on the project west of Nicholson Road.
Presented Pay Request E-13 for payment
MOTION VAUPEL SUPPORT REDINGER TO APPROVE PAYMENT OF
PAY REQUEST E-13 TO ENGINEERING TECHNOLOGIES IN THE AMOUNT
OF $9,511.85 AND TO AUTHORIZE THE SUPERVISOR’S SIGNATURE. 
MOTION CARRIED.

Discussion of water system on the Mitch Harris property, he is not ready to go forward with the project at this time and would like options for repaying the Township for the work already done. Board needs actual total before making any decisions.  Presented Pay Request E-25 from Engineering Technologies for payment.
MOTION EISELE SUPPORT TESCH TO AUTHORIZE PAY REQUEST E-25 FROM ENGINEERING TECHNOLOGIES IN THE AMOUNT OF $9,170.37 AND TO AUTHORIZE THE SUPERVISOR’S SIGNATURE.  ABSTAIN – VAUPEL.  MOTION CARRIED.

Revised contracts for sewer project on Sharpe Road have been dropped off. Brief discussion concerning contract with Engineering Technologies and a lack of billing rates on file, Mr. Cousino will make sure that the Clerk’s office has a copy.  Trustee Redinger questioned closing out the Van Buren project when there are still some who have not been paid.  Mr. Cousino stated that the project has not been finalized and those with outstanding bills can submit a claim on the bond for payment.

  1. Zoning Administrator’s Report

Report reviewed.  Administrator Anderson stated that permits are still slow and he is spending time on zoning violations.

Report reviewed.

  1. Attorney’s Report

Presented a revised version of nuisance ordinance to the Board for their review.  Attorney Kehoe is concerned that the definition of nuisance is very broad and also about the ability of a rural township like ours which has no police to enforce the ordinance. The violations of the nuisance ordinance would go through the same process as a zoning violation.

Pending Business Continued

  1. Community Education and Recreation Report

Kevin Swisher presented the report. Brief discussion concerning the Community Ed budget. Mr. Swisher also asked if there would be a board member who could be available for the Community Ed meetings if he were unavailable.  Clerk Eisele volunteered.

  1. Roads

Brief discussion concerning chloride applications. Supervisor Denby recommended that the Township contract with Advanced Dust Control again this year.
MOTION EISELE SUPPORT VAUPEL TO CONTRACT WITH ADVANCED DUST CONTROL FOR CHLORIDE APPLICATION AT A RATE OF 15 CENTS PER GALLON WITH A HEAVY APPLICATION FOR THE 1ST APPLICATION AND 3 ADDITIONAL LIGHT APPLICATIONS.  MOTION CARRIED.

  1. Front Door Remodel

Project has started and is coming along well.

New Business

  1. Salary Review Committee Appointments

Clerk Eisele recommends Jean Bohm and Jim Mayhew to serve on the salary review committee; she is waiting to hear from others who have been asked if they are able to serve. She requested that the Board approve the 3rd person at her discretion.
MOTION VAUPEL SUPPORT REDINGER TO APPOINT JEAN BOHM AND JIM MAYHEW AND A 3RD PERSON TO BE RECOMMENDED BY THE CLERK TO THE SALARY REVIEW COMMITTEE.  MOTION CARRIED.

  1. Klaus Gardening Contract Renewal for 2007

Board reviewed rates proposed by Klaus Gardening for Cemetery and Water Plant grass cutting and lawn maintenance.
MOTION EISELE SUPPORT TESCH TO CONTRACT WITH KLAUS GARDENING FOR LAWN MAINTAINANCE FOR THE CEMETARY AT A RATE OF $1,400.00 FOR THE GRASS CUTTING SEASON OF 2007 AND TO AUTHORIZE THE CLERK’S SIGNATURE.  MOTION CARRIED.

MOTION EISELE SUPPORT REDINGER TO CONTRACT WITH KLAUS GARDENING FOR LAWN MAINTAINANCE AT THE WATER PLANT AT A COST OF $45.00 PER CUTTING AND THE SEWER PLANT AT A COST OF $85.00 PER CUTTING AND TO AUTHORIZE THE CLERK’S SIGNATURE.  MOTION CARRIED.

  1. Zoning Amendment Z-09-07 Site Development Requirements – Off Street Parking, Loading and Unloading

Brief discussion concerning the revisions to the amendment and the concerns over the previous requirements
MOTION VAUPEL SUPPORT EISELE TO APPROVE ZONING AMENDMENT Z-09-07 SITE DEVELOPMENT REQUIREMENTS-OFF STREET PARKING, LOADING AND UNLOADING TO BE EFFECTIVE 7 DAYS AFTER PUBLICATION.  ROLL CALL VOTE.  REDINGER-AYE, VAUPEL-AYE, TESCH-AYE, DENBY-AYE, EISELE-AYE.  AYES-5, NAYS-0, ABSTAIN-0, ABSENT-0.  MOTION CARRIED.

  1. Zoning Amendment Z-10-07 Definitions-Two Family Dwellings

Brief discussion concerning the recommendations from the Livingston County Planning Commission. They did not understand from the minutes that the Planning Commission did have a public hearing concerning the amendment. Board would like the minutes clarified so that it is apparent that a public hearing was in fact held.

  1. Supervisor’s Report

Supervisor presented the budget allocation for 2007-2008.
MOTION EISELE SUPPORT TESCH TO ACCEPT THE 2007-2008 ALLOCATION BUDGET SUMMARY AND TO AUTHORIZE THE SUPERVISOR, CLERK AND TREASURER’S SIGNATURES.  ROLL CALL VOTE.  VAUPEL- AYE, TESCH-AYE, EISELE-AYE, DENBY-AYE, REDINGER-AYE.  AYES-5, NAYS-0, ABSTAIN-0, ABSENT-0.  MOTION CARRIED.

 

  1. Treasurer’s Report

Treasurer has settled with Livingston County. Reviewed report and discussed some concerns on personal property taxes still owing.  Attorney Kehoe will check if personal property taxes can be taken out of escrow accounts for those who have one and owe personal property taxes to Handy Township without their authorization.

  1. Clerk’s Report

Office is busy preparing for the May school election.
