REGULAR MEETING MINUTES

TUESDAY, JANUARY 9, 2007

The regular meeting of the Handy Township Board of Trustees was called to order in the Handy Township Boardroom by Supervisor Denby at 7:30 P.M. Members present: Eisele, Redinger, Vaupel and Tesch. Members absent: none. Also present: Township Attorney – Kehoe, Zoning Administrator – Anderson, Ken Cousino – Engineering Technologies, G & B Investments – Dennis Gottschalk, Desine Inc. – Chris Grzenkowicz, Fowlerville Rec – Kevin Swisher, Kevin Shopshire, and residents: Beth Badarak, Ron Hogbin, Roger King, Catherine Rosso and J.R. Hogbin.

Approval of Agenda

MOTION VAUPEL SUPPORT REDINGER TO APPROVE THE AGENDA AS PRESENTED. MOTION CARRIED.

Brief Public Comments

Kevin Swisher-Fowlerville Recreation Department discussed Conway Township pulling out of the association. They are trying to schedule a meeting for January 30^th and would like Handy Township to be present. Clerk Eisele will post meeting when date is confirmed.

MOTION TESCH SUPPORT EISELE TO PAY THE BILLS OF 1-9-07 IN

THE AMOUNT OF $48,280.11 FROM THE APPROPRIATE ACCOUNTS.

MOTION EISELE SUPPORT VAUPEL TO APPROVE PAYMENT OF PAY REQUEST E-11 TO ENGINEERING TECHNOLOGIES IN THE AMOUNT OF $12,281.00 AND TO AUTHORIZE THE SUPERVISOR’S SIGNATURE. MOTION CARRIED.

MOTION EISELE SUPPORT VAUPEL TO APPROVE PAYMENT OF PAY REQUEST NO. 12 IN THE AMOUNT OF $60,524.42 TO ROTHENBERGER COMPANY AND TO AUTHORIZE THE SUPERVISOR’S SIGNATURE. MOTION CARRIED.

B) Zoning Administrator’s Report

a) John McCurdy’s Easement

Brief discussion.

MOTION VAUPEL SUPPORT REDINGER TO AUTHORIZE THE TOWNSHIP ATTORNEY TO NEGOTIATE FOR SEWER EASEMENT WITH JOHN MCCURDY WITH A DOLLAR AMOUNT OF $750.00. MOTION CARRIED.

C) Assessor’s Report

MOTION TESCH SUPPORT VAUPEL TO ADOPT THE 2007 FEDERAL POVERTY GUIDELINES FOR ASSESSMENTS AS SUBMITTED BY THE ASSESSOR. MOTION CARRIED.

THE YEAR 2007 BOARD OF REVIEW BY MAIL. ROLL CALL VOTE.

E) Roads

Supervisor Denby has no report except for calls from residents complaining about the condition of the roads.

F) Front Door Remodel

Clerk Eisele reported that the project is going out to bid.

New Business

A) Nuisance Control Ordinance and Noise Ordinance for Board Consideration

Discussion concerning the ordinances and need for them. Residents on Nicholson Road have situation with barking dogs and would like an ordinance that will address this type of situation. Board reviewed the ordinances and Township Attorney Kehoe will make suggested changes and address concerns of the Board in a new draft for the February meeting. Zoning Administrator Anderson will look into zoning violations for 4.1, 4.2 and 2.2b concerning the barking dogs.

B) Handy Township Subdivision Development Ordinance No. 217

MOTION EISELE SUPPORT REDINGER TO ADOPT THE SUBDIVISION ORDINANCE NO. 217 FOR HANDY TOWNSHIP TO BE EFFECTIVE 30 DAYS AFTER PUBLICATION. ROLL CALL VOTE. EISELE – AYE, TESCH – AYE, VAUPEL – AYE, REDINGER – AYE, DENBY – AYE. AYES – 5, NAYS – 0, ABSTAIN – 0, ABSENT – 0. MOTION CARRIED.

C) Re-Appointment of Planning Commission, Zoning Board of Appeals and Board of Review Members.

MOTION EISELE SUPPORT TESCH TO RE-APPOINT KREBS AND COLSTON TO THE HANDY TOWNSHIP PLANNING COMMISSION FOR A

3 YEAR TERM ENDING 12-31-09. MOTION CARRIED.

MOTION EISELE SUPPORT TESCH TO RE-APPOINT NEWTON AND CROFOOT TO THE HANDY TOWNSHIP ZONING BOARD OF APPEALS FOR A 3 YEAR TERM ENDING 12-31-09. MOTION CARRIED.

MOTION EISELE SUPPORT TESCH TO RE-APPOINT WISURI, BRADY AND ELLIOTT TO THE HANDY TOWNSHIP BOARD OF REVIEW FOR A 2 YEAR TERM ENDING 12-31-08. MOTION CARRIED

D) Supervisor’s Report

Supervisor has received information that the Catholic Church is expanding, since part of their property lies in the Township and part in the Village they would like to petition to have all the property in the Village. The Boundary Committee will need to meet on this and members need to be re-appointed.

Supervisor Denby presented a bill from the PFM Group for payment.

MOTION EISELE SUPPORT TESCH TO PAY THE BILL FROM THE PFM GROUP IN THE AMOUNT OF $400.00. MOTION CARRIED.

E) Treasurer’s Report

Report presented and reviewed.

F) Clerk’s Report

Contract for school elections needs to be renewed. Will put on agenda for the special meeting Tuesday, January 16, 2007.

Extended Public Comments

Resident Catherine Rosso expressed concern that because of the dog-barking situation the Board might be considering lowering the number of dogs allowed. Board has no plans to direct the Planning Commission to address the issue at this time.
