SPECIAL MEETING MINUTES
September 19, 2008
A special meeting of the Handy Township Board of Trustees was called to order
at 4:00 P.M. by Supervisor Denby in the Handy Township Boardroom. Members present: Eisele, Tesch, Redinger and Vaupel. Also present: Township Attorney-Kehoe, Zoning Administrator-Anderson, Engineering Technologies – Ken Cousino (arrived 4:45), Livingston County Public Works Director – Brian Jonckheere, Hughes Land Surveyors-Darrell Hughes, Myers & Myers-Roger Myers and Vic Eggleston, DVM.
Approval of Agenda
MOTION EISELE SUPPORT REDINGER TO APPROVE THE AGENDA AS PRESENTED. MOTION CARRIED.

New Business
Vic Eggleston presented the plans that were approved for property that he holds the land contract on and has gotten back. He is concerned that he will lose the property because of unpaid taxes, special assessments and also leins on property from the work done. Mr. Eggleston stated that he had not received notice about the Special Assessment on his property in any way, shape or form.
Discussion concerning notices sent to property owners about Special Assessment, who must receive the notices, what constitutes an owner, publishment in newspaper, if bond payments could be restructured, how state and county deal with delinquent taxes and special assessment payments.
Township Attorney Kehoe will review the land contract after he receives a copy from Mr. Eggleston’s attorney, Mr. Myers. It was suggested that a copy of the land contract that Mrs. Eggleston had with Steelhead Development also be reviewed.
Mr. Eggleston stated that the taxes owed on property are more than what the property was sold for.
Supervisor Denby thanked Mr. Eggleston and Mr. Jonckheere for coming.
Board reviewed information for work proposed on the roof. Requested a quote for the total cost of work.

Reviewed agreement with Sr. Center.
MOTION EISELE SUPPORT VAUPEL TO ENTER INTO AN AGREEMENT WITH THE FOWLERVILLE SENIOR CENTER IN THE AMOUNT OF $5,000.00 AND TO AUTHORIZE THE CLERK’S AND SUPERVISOR’S SIGNATURES. MOTION CARRIED.
Discussed sample proposal sent by bank, Board will review and address at next regular business meeting. Township Attorney-Kehoe will also review proposal and give recommendation at next meeting. Trustee Vaupel thanked the Treasurer and Clerk for their concern over safeguarding the Township monies.
1. Discussed concerns over need for an additional assistant. Supervisor Denby was approached by a township resident who was interested in working as an assistant. Trustee Vaupel and Clerk Eisele will meet with him to discuss the job.
2. Discussed need for application for connection and who is able to inspect connection if Zoning Administrator is unable to do this. Contracts with Hughes Environmental Services and MMJ Waters allow for them to inspect connection.
A RESOLUTION WAS OFFERED BY EISELE AND SUPPORTED BY REDINGER TO ESTABLISH A $150.00 INSPECTION FEE FOR CONNECTION
TO THE WASTEWATER TREATMENT SYSTEM. ROLL CALL VOTE.
VAUPEL-AYE, DENBY-AYE, TESCH-AYE, EISELE-AYE, AND
REDINGER-AYE. AYES-5, NAYS-0, ABSTAIN-0, ABSENT-0.
RESOLUTION DECLARED ADOPTED.
3. Meter costs have risen. Need to update pricing.
MOTION VAUPEL SUPPORT EISELE TO AUTHORIZE THE ESTABLISHMENT OF THE FEE FOR ALL METERS TO BE THE PREVAILING MARKET RATE PLUS THE APPLICABLE TOWNSHIP CONNECTION FEE. MOTION CARRIED.
Discussed need to keep billing rates updated on a yearly basis and Clerk requested that the engineering bills reflect the billing detail on the sheet presented. Clerk also requested an original copy of billing rates signed by Mr. Cousino.
MOTION EISELE SUPPORT VAUPEL TO HIRE ENGINEERING TECHNOLOGIES AS THE TOWNSHIP ENGINEER AT THE 2008 BILLING RATES AS PROVIDED TO THE TOWNSHIP. MOTION CARRIED.
