HANDY TOWNSHIP REGULAR BOARD MEETING

AUGUST 10, 2004

 

 

      The regular Handy Township Board meeting was called to order by Supervisor Denby at 7:30 p.m. in the Handy Township boardroom.  Members present: Tesch, Vaupel, Denby, Eisele.  Absent: Krebs.  Also Present: Township Attorney Kehoe, Zoning Administrator Anderson, Maureen Cousino-Engineering Technologies, and Sue Ward-Deputy Treasurer.

 

Approval of Agenda:

 

MOTION EISELE SUPPORT VAUPEL TO APPROVE THE AGENDA AS SUBMITTED.   MOTION CARRIED.

 

Approval of Minutes:

 

A) Township Board Regular Meeting of July 13, 2004:

 

MOTION EISELE SUPPORT VAUPEL TO APPROVE THE MINUTES OF THE

JULY 13, 2004 REGULAR MEETING AS PRESENTED.   MOTION CARRIED.

 

B) Township Board Special Meeting of July 20, 2004:

 

      A wording change under New Business, Item (A) to read…”Mr. Stankov stated that the GLCNHC was tax exempt from property taxes until approximately 1999...

 

MOTION VAUPEL SUPPORT EISELE TO APPROVE THE MINUTES OF THE JULY 20, 2004 SPECIAL MEETING AS AMENDED.   MOTION CARRIED.

 

Brief Public Comments:

 

      None.

 

Approval of Bills:

 

MOTION  VAUPEL SUPPORT EISELE TO PAY THE BILLS OF AUGUST 10, 2004 FROM THE APPROPRIATE ACCOUNTS IN THE AMOUNT OF $52,010.36.

Pending Business:

 

A) Community Education-Recreation Report:

 

      A packet from Wendy Hillier-Recreation Coordinator, containing an account summary, expenses, revenues, and an enrollment summary was submitted for review.  It was noted that the participant enrollment dropped in 2003.

 

B) Zoning Administrator’s Report:

 

      Submitted. Zoning Administrator Anderson stated that the Red Cedar Crossing development has most underground infrastructure completed and are starting construction on the roads.

      Mr. Anderson also questioned the keeping of animals ordinance concerning 4-H children who live on small lots and wish to raise small livestock.

 

C) Assessor’s Report:

 

      Submitted

 

D) Solid Waste Committee:

 

      None.

 

E) Roads:

 

      None.

 

F) WWTP-Van Buren Road-Engineer’s Report:

 

      Maureen Cousino-Engineering Technologies stated that pay request A-14 had some items that needed to be amended and re-approved.

 

MOTION EISELE SUPPORT TESCH TO APPROVE THE REVISED PAY REQUEST A-14 TO F. J. JONES & CO. IN THE AMOUNT OF $242,574.51 AND AUTHORIZE THE SUPERVISOR TO SIGN THE PAY REQUEST.   VAUPEL-ABSTAIN.

MOTION EISELE SUPPORT TESCH TO APPROVE PAY REQUEST A-15 TO

F. J. JONES & CO. IN THE AMOUNT OF $335,592.61 AND AUTHORIZE THE SUPERVISOR TO SIGN THE PAY REQUEST.   VAUPEL-ABSTAIN.

MOTION CARRIED.

 

      Discussion of Change Order A-13 in which sales tax was added.  Clerk Eisele reported that government agencies do not pay sales tax and a mistake may have been made.  Maureen Cousino stated that she would further investigate.

      Miss Cousino reported that the Engineer Technologies’ contract with Livingston County needed an extension amendment.

 

MOTION EISELE SUPPORT TESCH TO AUTHORIZE CONTRACT AMENDMENT E-2 DATED

7-27-04 BETWEEN ENGINEER TECHNOLOGIES AND LIVINGSTON COUNTY IN REGARD TO THE HANDY TOWNSHIP INFRASTRUCTURE IMPROVEMENTS.   VAUPEL-ABSTAIN.

MOTION CARRIED.

 

      The Livingston Co. budget and account summary was submitted for review along with the update for equipment allowances budget.  A discussion followed concerning the contractor project delay and rate schedules for the Special Assessment District.

 

G) Township Property-Hogback Road Landfill:

 

      None.

 

H) Township Building Remodel-137 N. Grand Ave (painters quote of $7,875.00):

 

      None.

 

I) Mike Wallace/Update on Zoning Ordinance Violation:

 

      Zoning Administrator Anderson reported that Mr. Carl Stepen will take possession of the building on August 13th.

New Business:

 

A) Zoning Amendment #Z-62-04 Accessory Bldg in Side Yard:

 

      Review of amendment and Livingston Co. recommendations.  Discussion that accessory buildings could possibly look complementary to the home instead of matching.  Zoning Administrator Anderson stated that the intent was that the side yard needs to match the home as nearly as possible, and the rear yard could be different.

      It was decided to add the wording …”the accessory building must be constructed so the exterior of the accessory building is complementary and matches, as nearly as possible….”.  Also the wording be changed to “required side yard setback.”

 

MOTION VAUPEL SUPPORT EISELE TO ADOPT ZONING AMENDMENT

#Z-62-04 ACCESSORY BUILDING IN SIDE YARD WITH THE ADDED LANGUAGE TO BECOME EFFECTIVE 7 DAYS AFTER PUBLICATION.   MOTION CARRIED.

 

B) Zoning Amendment #Z-63-04 Re: Signs:

 

      Review of amendment and Livingston Co. recommendations.  Discussion of present signs and density of possible future developments.

C) Zoning Amendment #Z-64-04 Re: Lighting:

 

      Review of amendment and Livingston Co. recommendations.  Zoning

Administrator Anderson stated that the county stated enforcement issue would be addressed at site plan reviews.

D) Zoning Amendment #Z-65-04 Re: Driveway Setback:

 

      Review of amendment and Livingston Co. recommendations.  Discussion of driveway width requirements and if the requirement should be 10 feet wide instead of 12 feet.

E) Basic Technologies, Inc., Proposal for Document Imaging System:

 

      Discussion of the possibility of obtaining other township references before any further action is taken.

 

F) Supervisor’s Report:

 

      Supervisor Denby reported that the Fire Authority Millage passed and expressed thanks for support.  She reported that the District Fire

Department Board was discussing a fare pay back price due to the Fowlerville Fire Board for equipment and turnout gear.

 

I) Treasurer’s Report:

 

      Submitted and reviewed.

 

I) Clerk’s Report:

 

      Clerk Eisele requested the renewal of the contract with Active Bookkeeping Services for technical support for the quick books accounting and ledger program.

 

MOTION EISELE SUPPORT VAUPEL TO CONTRACT WITH ACTIVE BOOKKEEPING SERVICES FOR ONE YEAR OF TECHNICAL SUPPORT AT A FEE OF $325.   MOTION CARRIED.

 

      Clerk Eisele submitted a letter from the Village of Fowlerville concerning the sale of election equipment.  Discussion of the asking prices for said equipment.  It was decided that Handy Township would not submit any bids to the Village.

      Clerk Eisele discussed Zoning Ordinance Section 2.23, temporary dwellings,

concerning parking mobile homes at residences for longer than 30 days.  She requested that the Planning Commission review this ordinance to possibly allow for special situations, such as the visitation of family members.

 

MOTION EISELE SUPPORT VAUPEL TO SUBMIT THAT THE PLANNING COMMISSION REVIEW SECTION 2.23 SUBSECTION A-2 TO ALLOW FOR SPECIAL SITUATIONS.   MOTION CARRIED.

 

  Extended Public Comments:

 

      Zoning Administrator Anderson reported that Planning Commission Member T. Eftaxiadis purchased a map of Handy Township at a cost of $60.

 

MOTION EISELE SUPPORT VAUPEL TO AUTHORIZE T. EFTAXIADIS TO PURCHASE A GIS MAP FROM LIVINGSTON COUNTY GIS DEPARTMENT FOR A COST OF $60.   MOTION CARRIED.

 

MOTION EISELE SUPPORT VAUPEL TO REIMBURSE T. EFTAXIADIS FOR THE PURCHASE OF THE GIS MAP FOR A COST OF $60.   MOTION CARRIED.
