MEETING
FEBRUARY 2, 2004
The Handy Township Special Board meeting was called to order by
Supervisor Denby at 7:30 p.m. in the
Vaupel, Denby,
Eisele.
Absent: Krebs, Tesch. Also Present: Township Attorney Kehoe, Zoning
Administrator
Approval of Agenda:
MOTION VAUPEL SUPPORT EISELE
TO APPROVE THE AGENDA AS PRESENTED.

New Business:
A) Discussion of Dykema-Gossett
First Amendment to Consent Judgment:
Review of
Alan Greene-Dykema Gossett, PLLC addressed these concerns by stating
that:
The homes built would all be
stick built homes on permanent foundations; The setback standards and utility
placements have been mutually agreed upon and will be clearly detailed on the
final site plan; The streets in the development are now 27’ wide and parking
will be allowed on one side of the street to be stipulated in the Master Plan
and By-Laws of the development; Deck placement in the back yards will not be
over the utilities; Sidewalks will be present; All play areas will be fenced
in. Mr. Greene stated that the detailed
site plan would be attached to the amended consent judgment.
Discussion of the construction commencement
timeline. Mr. Greene stated that
current plans are to begin construction in early spring. He also stated that he wishes a provision be
in the consent judgment that will allow Elro Corp. to
go ahead and build this development if the current developer reneges on his
agreement. He also wanted to reserve the
right to have the original mobile home park as an alternative if current plans
fall through.
Mr. Greene explained that the term ‘administrative approval’ in
the consent judgment means that the judgment will meet
approval, but no public hearing will
be held.

Review of the Land Use Permit procedure. Zoning Administrator Anderson stated that a
county building permit cannot be obtained unless a Land Use Permit is approved
by
Mr. Greene stated that provisions would be made in the consent
judgment that will bond the purchaser/developer of the property to the consent
judgment. He also stated that a copy of
the Master Deed and By-Laws would be submitted for the township’s review before
the consent judgment is submitted.
Discussion of construction trailers and their
need to be moved away in a timely manor.
Mr. Greene stated that permits for the floor model homes should not be
necessary since the homes will be incorporated early into the condominium
project. No opposition shown.
Mr. Greene stated that a mutually agreed upon area for school
bus pickup would be designated. He also
stated that some type of street lighting would be provided.
Supervisor Denby inquired about the
water system that will be used for this development. Mr. Greene stated that the well will be built
and that Elro Corp. will incur all of its building
costs. At which time the well will be
turned over to
Mr. Greene requested the board members sign a submitted permit
application for a water supply system.
Ken Cousino requested a couple of days for its
review. It will be reviewed again by the
members at the next regular board meeting.
