SPECIAL MEETING MINUTES
THURSDAY, AUGUST 28, 2008
The regular meeting of the Handy Township was called to order in the Handy Township Boardroom by Supervisor Denby at 4:00 P.M. Members present: Redinger and Eisele. Absent: Tesch and Vaupel. Also present: Township Attorney-Kehoe and residents Gary and Sandy Weaver.
Approval of Agenda
MOTION REDINGER SUPPORT EISELE TO APPROVE THE AGENDA AS PRESENTED. MOTION CARRIED.
Brief Public Comments No comments.
New Business
Brief discussion concerning the State of Michigan Employment Security Board of Review decision and letter from Township Attorney. Supervisor Denby reported that she did not fully agree with the Board’s findings and that she believes that parts of the statute were interpreted incorrectly. Supervisor Denby also expressed concerns over the cost of further appealing the matter. Her final recommendation was to forgo continuation of the matter.
MOTION REDINGER SUPPORT EISELE TO FORGO THE OPPORTUNITY TO APPEAL THE DECISION BY THE MICHIGAN BOARD OF REVIEW APPEAL DOCKET #B 2005 11907 R01 188795W IN THE WEAVER V. HANDY TOWNSHIP UNEMPLOYMENT MATTER. MOTION CARRIED.
Brief discussion of changes that were made to documents from FEMA.
A RESOLUTION WAS OFFERED BY EISELE AND SUPPORTED BY REDINGER TO ADOPT THE COMMUNITY RESOLUTION AND INTERGOVERNMENTAL AGREEMENT TO MANAGE FLOODPLAIN DEVELOPMENT FOR THE NATIONAL FLOOD INSURANCE PROGRAM AND TO AUTHORIZE THE SUPERVISOR’S SIGNATURE AS WITNESSED
BY THE CLERK. ROLL CALL VOTE. EISELE-AYE, DENBY-AYE,
REDINGER-AYE. AYES-3, NAYS-0, ABSENT-2, ABSTAIN-0.
RESOLUTION DECLARED ADOPTED.
MOTION EISELE SUPPORT REDINGER TO ADOPT ORDINANCE NO. 220 ADDRESSING FLOODPLAIN MANAGEMENT PROVISIONS OF THE STATE CONSTRUCTION CODE TO BE EFFECTIVE 7 DAYS AFTER PUBLICATION AND TO AUTHORIZE THE CLERK’S AND SUPERVISOR’S SIGNATURES. ROLL CALL VOTE. REDINGER-AYE, EISELE-AYE, DENBY-AYE. AYES-3, NAYS-0, ABSENT-2, ABSTAIN-0. MOTION CARRIED.

Extended Public Comments
Attorney Kehoe discussed his letter dated August 28, 2008 regarding the Chestnut Development, LLC v. Handy Township matter. Mediation is scheduled for Tuesday, September 23, 2008 at 10:00 A.M. Discussion in regard as to whom should attend as representatives from the township. It was decided that the Clerk and Planning Commission liason (Trustee Redinger) attend the mediation. No further discussion.
