The regular Handy Township Planning Commission was called to order by Chairman Hummel at 7:30 p.m. in the Handy Township Board Room. Members Present: Elliott, Frazier, Krebs, Colston. Absent: None. Also Present: Supervisor Vaupel, Attorney Kehoe, Engineering Technologies-Ken Cousino, Desine, Inc.-Chris Grzenkowicz, Midtown Service-Jim Passow, and Matt Colston.
Approval of Agenda:
MOTION ELLIOTT SUPPORT KREBS TO APPROVE THE AGENDA AS PRESENTED. MOTION CARRIED.

No comments from the public were made. Mr. Passow briefly described the type of service he would be providing.

Old Business
Discussion on lowering the height to 60 feet. Due to continued legislation on wind generation and untested language, Attorney Kehoe recommended the Commissioners wait until March or April before moving forward with any proposed language. The State is talking about any area as long as it’s not residential. Handy Township is mostly residential. Currently, there is windmill allowances in the ordinance, roughly 80 feet. Further discussion at next meeting.
Discussion about ordinance amendment. Possibly restrict home occupations to AR only. There was also discussion with John about what the Commissioners may want to see as far as changes in the ordinance for 2009.
New Business:
Chris Grzenkowicz-Desine, Inc. reviewed the site plan for Midtown Services. Some of the highlights are as follows: proposed auto service facility, NSC Zoning, 2/3 acre lot, service bay in rear, office in front, detention pond out front, non-conforming site. Proposed site improvements include: relocation of site entrance, modified detention basin to capture more run off, dumpster screening to be placed in rear of building, evergreens and sign out front. The plan is to commence by June 1 and complete by August 31, 09. Actually includes 2 phases. Phase 1 will bring the site into conformance and Phase 2 is beautification of the area including increasing parking lot size and repaving, sidewalk completion by October 31, 2009, future screening, vehicles to be kept inside, no outside overnight parking. They requested a temporary use permit to operate the business. Township Engineer and Planner did not object to the temporary use permit.
MOTION KREBS SUPPORT ELLIOTT TO APPROVE THE SITE PLAN FOR MIDTOWN SERVICES CONDITIONED UPON COMPLIANCE WITH TOWNSHIP ENGINEER’S RECOMMENDATION IN A LETTER DATED DECEMBER 11, 2008, SPECIFICALLY ITEMS 1, 2, 4, BEFORE ANY OPERATIONS BEGIN ON A TEMPORARY BASIS, WITH IMPROVEMENTS BEGINNING JUNE 1, 2009 AND FINISHING BY AUGUST 31, 2009 FOR PHASE ONE. MOTION CARRIED.

MOTION KREBS SUPPORT ELLIOTT TO APPROVE THE SPECIAL USE PERMIT FOR MIDTOWN SERVICES AS PROPOSED CONDITIONED UPON THERE BE NO OUTDOOR STORAGE, RESTRICTED HOURS OF OPERATION TO MONDAY THROUGH SATURDAY 6 A.M. TO 8 P.M., NO MORE THAN 8 VEHICLES FOR OUTSIDE STORAGE BASED UPON HANDY TOWNSHIP ZONING ORDINANCE SECTION 16.3, 16.6 NN, IN ACCORDANCE WITH TOWNSHIP PLANNERS LETTER DATED DECEMBER 8, 2008, AND THAT SIDEWALK EASEMENT BE PROVIDED TO TOWNSHIP ATTORNEY. MOTION CARRIED.
Discussion on language for joint/shared driveways. Attorney Kehoe and Planner John Enos will look into modified language in time for next meeting.

Call To The Public:
Matt Colston questioned whether there would be sidewalks from the Village to the new post office and also on the south side of the expressway along Fowlerville Road to Van Buren Road.
It was explained that the township does have a sidewalk plan in place for future development.
