REGULAR PLANNING COMMISSION MINUTES
JULY 24, 2008

The regular Handy Township Planning Commission meeting was called to order by Chairman Hummel at 7:30 p.m. in the Handy Township Board Room.  Members Present: Elliott, Redinger, Colston.  Absent: Krebs.  Also Present: Attorney Kehoe, Engineering Technologies-Ken Cousino, Carlisle Wortman-John Enos, Wilcox-Andy Harris, EDC-Fred Dillingham, Aisin Corporation-Taka Konishi & Mack Yuasa, and residents Peggy Dey, Mark Scherer, Dough Cornett, Ron Cooper and Paula Wallace.

Approval of Agenda:
To add under the first close public hearing the words, “OPEN PUBLIC HEARING”.
MOTION REDINGER SUPPORT COLSTON TO APPROVE THE AGENDA AS AMENDED.  MOTION CARRIED.

There were no comments received by the Commissioners from the public.

MOTION ELLIOTT SUPPORT REDINGER TO CLOSE THE PUBLIC HEARING FOR THE RE-ZONING OF PROPERTY REQUEST FROM H. WARD AND PEGGY DEY AND REUTRN BACK TO REGULAR BUSINESS SESSION AT 7:33 P.M.  MOTION CARRIED.

There was a 2 minute time period in the meeting between public hearings at which time the Commissioners reviewed the minutes of the last regular planning commission meeting.
One amendment, Page 2, Item B), 4th line of motion, correct the word “veing” to reflect “being”.

MOTION ELLIOTT SUPPORT REDINGER TO GO OUT OF REGULAR BUSINESS SESSION AND OPEN THE PUBLIC HEARING FOR THE HANDY TOWNSHIP ZONING AMENDMENT #2008-3, WHICH INCLUDES VARIOUS PORTIONS OF CHAPTERS 10, 16, & 17 OF THE HANDY TOWNSHIP ZONING ORDINANCE, AT 7:35 P.M.  MOTION CARRIED.

Township Planner, John Enos, and Attorney Kehoe reviewed the various changes in Zoning Amendment #2008-3 for the Handy Township Ordinance with the Commissioners.  There were no comments from the public.

MOTION REDINGER SUPPORT COLSTON TO CLOSE THE PUBLIC HEARING FOR THE HANDY TOWNSHIP ZONING AMENDMENT #2008-3 AND RETURN TO REGULAR BUSINESS SESSION AT 7:38 P.M. 
MOTION CARRIED.

  1. Re-Zoning of Property, H. Ward and Peggy Dey, AR to I-2. 

The members discussed the proposal, including the Master Plan, adjacent area and generally favorable circumstances surrounding the request.

MOTION REDINGER SUPPORT ELLIOTT TO RECOMMEND TO THE TOWNSHIP BOARD THE APPROVAL OF THE REQUEST TO RE-ZONE PARCEL NO. 05-16-200-004 FROM AR AGRICULTURAL RESIDENTIAL TO
I-2 GENERAL INDUSTRIAL SUBMITTED BY H. WARD AND PEGGY DEY, BECAUSE THE REQUEST IS CONSISTENT WITH THE MASTER PLAN FOR THE AREA, THE AREA ACROSS THE STREET IS ZONED, IS USED FOR SIMILAR USES AND THE RE-ZONING WOULD BE COMPATIBLE WITH THE PLANNED FUTURE USE OF THE AREA, AND THERE WERE NO COMMENTS FROM THE PUBLIC AGAINST THE RE-ZONING.  I ALSO REQUEST THAT THIS BE REFERRED TO THE LIVINGSTON COUNTY PLANNING DEPARTMENT FOR ITS REVIEW AND RECOMMENDATION.

  1. Handy Township Zoning Amendment #2008-3. 

The members discussed the Proposed amendments favorably as being in the best interest of the Township.
MOTION REDINGER SUPPORT ELLIOTT TO RECOMMEND ADOPTION OF THE HANDY TOWNSHIP ZONING AMENDMENT #2008-3 BY THE TOWNSHIP BOARD OF TRUSTEES AND THAT IT BE REFERRED TO THE LIVINGSTON COUNTY PLANNING DEPARTMENT FOR REVIEW AND RECOMMENDATION.  MOTION CARRIED.

Matters Pertaining to the General Citizenry:              No comments from the public.

New Business:

  1. Fowlerville Test Track Site Plan Review (Phase 3, Tunnel Extension)

MOTION ELLIOTT SUPPORT REDINGER TO POSTPONE ANY DECISION ON THE FOWLERVILLE TEST TRACK SITE PLAN, PHASE 3, TUNNEL EXTENSION, BECAUSE IT WILL ALLOW TIME FOR APPLICANT TO ADEQUATELY ADDRESS THE TOWNSHIP ENGINEER AND LIVINGSTON COUNTY DRAIN COMMISSIONER CONCERNS IN THEIR LETTERS DATED JULY 10, 2008 AND JULY 21, 2008.  MOTION CARRIED.

  1. Wind Energy Conversion System-Discussion

Township Planner, John Enos, discussed that this issue is currently up for vote in the state legislature which exempts wind energy devices from Zoning Ordinances.  However, a residential unit could be added to the zoning language.  Township resident, Ron Cooper, came forward and discussed with the board the importance of wind energy and that he is currently in the process of creating a system at his home.  He urged the Commissioners to continue with the implementation of wind energy conversion systems in the zoning ordinance.  There was also discussion on the different types of systems available currently along with waive barriers, fall zones, free standing & guide wire supported towers and some of the various problems that individuals could run into.  There will be further discussion at the next regular meeting on August 28, 2008.
