REGULAR MEETING

FEBRUARY 25, 2010

 

The Handy Township regular Planning Commission meeting was called to order by Chairman Hummel at 7:30 p.m.  Members Present: Redinger, Elliott, Krebs, Frazier.  Absent: None.  Also Present: Attorney Kehoe, Zoning Administrator Call, Carlisle-Wortman-Laura, and residents Owen Mack & William Brewer.

 

Approval of Agenda: 

MOTION ELLIOTT SUPPORT REDINGER TO ACCEPT THE AGENDA AS PRESENTED.  MOTION CARRIED.

 

Matters Pertaining to the General Citizenry:             No comments.

 

Business Session:

A)   Planning Commission Regular Meeting Minutes of 10-22-09

MOTION ELLIOTT SUPPORT KREBS TO ACCEPT THE MINUTES OF

10-22-09 REGULAR MEETING AS PRESENTED.  MOTION CARRIED.

 

Old Business:

A)   Geraldine Brewer (Landscape Business) Site Plan Review

The Commissioners discussed the following items:

1.     Compliance with DNRE (Dept. of Natural Resources & Environ. Equality) questioning whether or not Mr. Brewer had cut into his parking area after removing the fill dirt.  Site Plan should show the new parking area to make sure it fits within the requirement of the ordinance including enough spaces.  Also, concerns with layout of storage units.

It was agreed that Mr. Brewer would make the necessary changes to his site plan and re-submit for action later in the meeting.

MOTION REDINGER SUPPORT KREBS TO LAY THE SITE PLAN REVIEW FOR GERALDINE BREWER (LANDSCAPE BUSINESS) ON THE TABLE AT 8:10 P.M.  MOTION CARRIED.

 

During the next few minutes, Mr. Brewer prepared his site plan for re-submission to the Planning Commission.  The Commissioners moved on and discussed Old Business, Item C) Zoning Amendment-Outdoor Wood Fired Boiler and Furnace

 

MOTION KREBS SUPPORT REDINGER TO REMOVE THE SITE PLAN FOR GERALDINE BREWER (LANDSCAPE BUSINESS) FROM THE TABLE AT

(Old Business, Item A) Geraldine Brewer (Landscape Business) Site Plan Review, continued)

The Commissioners reviewed the amended site plan submitted by Mr. Brewer.

MOTION REDINGER SUPPORT KREBS TO APPROVE THE SITE PLAN FOR GERALDINE BREWER (LANDSCAPE BUSINESS) FOR THE SALE OF LANDSCAPE MATERIALS AS AMENDED, SIGNED, AND DATED 2-25-2010 BY WILLIAM BREWER.  MOTION CARRIED. 

 

B)   Geraldine Brewer (Landscape Business) Special Use Permit

The Commissioners discussed the following concerns:

1.     Natural buffer on the east side of the property to shield any neighbors from the business

2.     Asphalt grindings to be used on driveway to help with dust control

3.     Limiting the hours of operation to no more than Mon.-Sat. 7 a.m. to 6 p.m.

MOTION KREBS SUPPORT REDINGER TO APPROVE THE SPECIAL USE PERMIT FOR GERALDINE BREWER (LANDSCAPE BUSINESS) WITH CONDITIONS THAT THE APPLICANT MAINTAIN THE GREEN BUFFERING ALONG THE EAST SIDE OF THE PROPERTY AND USE ASPHALT MILLINGS ON THE DRIVEWAY AND PARKING AREAS FOR CONTROLLING DUST BASED UPON THE FINDINGS THE APPLICATION MEETS THE REQUIREMENTS IN SECTION 16.3 A, 1-5 OF THE HANDY TOWNSHIP ZONING ORDINANCE.  MOTION CARRIED.

 

C)   Zoning Amendment-Outdoor Wood Fired Boiler or Furnace

Discussion on the proposed amendment by the Commissioners in regard to establishing a guideline for the township to follow in the case a problem arises with outdoor wood furnaces.  It was decided to schedule a public hearing for the proposed amendment to be scheduled by the ClerkÕs office at the next regular meeting of the Planning Commission.

 

D)   Zoning Amendment-Wind-Energy Generation Systems

Zoning Administrator Call requested the proposed Wind-Energy Generation System Zoning Amendment be placed at committee level for further discussion.  Chairman Hummel and Commissioner Frazier were appointed to serve on the committee with Zoning Administrator Call.

E)    Discussion on Right-of-Way Widths (Bill Call)

Zoning Administrator Call reported on the 10 foot right-of-way widths on each side of the 66 foot private road right-of-way easement.  He feels it is unnecessary because all public utilities are able to fit within the 66 foot right-of-way.  Attorney Kehoe suggested removing the last 2 sentences of Section 2.19, Private Roads, Paragraph C.

It was decided to schedule a public hearing for the proposed amendment to be scheduled by the ClerkÕs office at the next regular meeting of the Planning Commission.

            A) Election of Officers (Chair, Vice-Chair and Secretary)

MOTION ELLIOTT SUPPORT KREBS TO NOMINATE LARRY HUMMEL TO FILL THE POSITION OF CHAIRMAN FOR THE PLANNING COMMISSION FOR THE YEAR 2009-2010.  MOTION CARRIED.

 

MOTION ELLIOTT SUPPORT KREBS TO CLOSE THE NOMINATIONS  APPOINTING LARRY HUMMEL AS THE CHAIRMAN FOR THE PLANNING COMMISSION FOR THE YEAR 2009-2010.  MOTION CARRIED.
